Patents essential to standards
Patents considered essential to implement some technical standards (such as 5G or Wi-Fi) can be found in all our technological devices (from smartphones to connected cars). The SEP Regulation has the potential to materially change the landscape of patent licensing in the “tech world” in the EU, but also worldwide. We welcome the Commission's proposal, reinforced by the EP's JURI report, which aims to increase fairness, transparency and non-discriminatory licensing practices for standard essential patents, which should enable SMEs and consumers to benefit from innovative products based on the latest standard technologies at a fair price. The EP report also introduces clearer objectives, taking into account the interests of the creators of open standards, who should be encouraged to participate in the collaborative standardization effort in the EU.
