Determination of a clear risk of a serious breach by the Republic of Poland of the rule of law
I voted in favour of this resolution, in line with the Group of the Greens/EFA, because it sends a strong signal to the Council on how to approach this process.
The Commission was right to trigger Article 7 (1) of the EU Treaty in the case of Poland - in fact, judicial reforms in recent years undermine the rule of law, which is one of the foundational values of the EU. We condemn the lack of efficient action in the Council and the situation has been deteriorating for almost three years. The Council should as soon as possible decree the existence of a clear risk of a serious violation of Union values and make recommendations to Poland in this regard.
However, the Commission made a mistake in excluding democracy and fundamental rights from its proposal. We demand that developments related to the electoral process, freedom of the press, freedom of assembly, sexual and reproductive health and rights, LGBTI + rights, as well as minority rights, be fully considered during discussions under Article 7 in the Council.
